The Club Golf is owned and operated by Clubhouse Labs, LLC, a Florida limited liability company ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the website at theclubgolf.co and our mobile and web apps (together, the "Service"). By creating an account or using the Service, you agree to these Terms.
1. The Service
The Club Golf is a recreational and social golf networking platform. It is designed to help golfers connect, find playing partners, log scores, run informal side games among friends, and share their love of the game. It is not a wagering, gambling, or sports-betting service. Any side-game stakes are private agreements between friends and are entirely the responsibility of the participants.
2. User Accounts
- You must be at least 13 years old (or the age of digital consent in your country, whichever is higher) to create an account.
- You must provide accurate information when registering and keep it up to date.
- You are responsible for keeping your password confidential and for all activity that occurs under your account.
- You must notify us immediately at support@theclubgolf.co if you believe your account has been compromised.
- One account per person. You may not share, sell, or transfer your account.
3. Acceptable Conduct
To keep The Club Golf a welcoming community, you agree not to:
- Harass, threaten, bully, stalk, or abuse other users.
- Post content that is hateful, discriminatory, sexually explicit, violent, or otherwise inappropriate.
- Impersonate any person or entity, or misrepresent your identity, age, or handicap in a deceptive way.
- Use the Service for any illegal purpose or to violate any applicable law or regulation.
- Send spam, unsolicited messages, or commercial solicitations.
- Interfere with, scrape, or attempt to gain unauthorized access to the Service or other users' accounts.
- Use the Service to facilitate large-scale or commercial gambling activities.
4. Community Safety — Blocking & Reporting
Every user has tools to keep their experience safe:
- Block — you can block any user from their profile or from any post, comment, or message they've sent. Blocking is silent and mutual: the blocked user cannot see your content, cannot message you, cannot match with you, and is not notified they were blocked. You can view and unblock users at any time from Settings → Blocked Users.
- Report — you can report any user, post, comment, direct message, or discover card that appears to violate these Terms. Reports go to our safety team at abuse@theclubgolf.co and are reviewed within 24 hours. Categories include harassment, hate speech, sexual content, violence or threats, impersonation, spam or scam, self-harm, and other.
Filing knowingly false or malicious reports may result in action against your own account, up to and including permanent removal.
5. No Harassment or Abuse
We have zero tolerance for harassment, abuse, or threats of any kind. If you experience or witness this behavior, please use the in-app Report feature or email abuse@theclubgolf.co. We review every report and may warn, suspend, or permanently ban users who violate these standards.
6. Location-Based Features
Some features (such as nearby-golfer matching, course discovery, and certain map tools) use your device's location data. You can grant or revoke location permission at any time through your device settings. When you enable location access, you agree that we may collect and process your location to provide these features as described in our Privacy Policy. Location estimates are not guaranteed to be perfectly accurate and should not be relied on for navigation or safety-critical purposes.
6. User Content
You retain ownership of the content you post (profiles, photos, posts, comments, scores, messages, etc. — "User Content"). By posting User Content you grant Clubhouse Labs, LLC a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content as needed to operate and improve the Service. You are responsible for your User Content and represent that you have all rights necessary to share it.
7. Right to Suspend or Terminate
We reserve the right, at our sole discretion, to warn, suspend, restrict features for, or permanently terminate any account that we reasonably believe has misused the platform, violated these Terms, or behaved in a way that harms other users or the integrity of the Service. We may do this with or without prior notice. You may also delete your account at any time through the in-app Settings or by visiting our Account Deletion page.
8. Intellectual Property
The Service — including all software, design, logos, trademarks, and content other than User Content — is owned by Clubhouse Labs, LLC or its licensors and is protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
9. Third-Party Services
The Service may integrate with third-party services (such as email delivery, mapping, push notifications, or external golf data). We are not responsible for the availability, content, or practices of those services. Your use of those services is subject to their own terms.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, secure, or that scoring/handicap data will be perfectly accurate.
11. Limitation of Liability
To the fullest extent permitted by law, Clubhouse Labs, LLC and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms or the Service is limited to one hundred U.S. dollars (US $100).
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Clubhouse Labs, LLC and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party right, including any side-game dispute with another user.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. Before filing any formal claim, you agree to attempt to resolve the dispute informally by contacting support@theclubgolf.co. If we cannot resolve the dispute within 60 days, either party may pursue formal proceedings in the state or federal courts located in Florida.
14. Changes to These Terms
We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date and, for material changes, notify you by email or in-app notice. Continued use of the Service after the update constitutes acceptance.
